These Terms and Conditions (“Terms”) govern your access to and use of our website, including any content, functionality, and services offered on or through our site (the “Site”), as well as your purchase of camera straps, accessories, and related products (“Products”) from us.

By accessing our Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our Site or purchase our Products.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order on our Site. By using our Site, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

Product colors and appearance may vary slightly due to photography, lighting, and individual display settings

4. Orders and Payment

When you place an order with Punctum:

Your order constitutes an offer to purchase, which we may accept or decline at our discretion
We reserve the right to refuse or cancel any order for reasons including product availability, errors in pricing or product information, or suspected fraudulent activity
Payment must be made in full at the time of purchase using an accepted payment method

We use third-party payment processors to handle transactions securely; by making a purchase, you agree to their applicable terms as well
All sales are subject to acceptance and order confirmation, which we will send via email

5. Shipping and Delivery

We aim to process and ship your order as quickly as possible. Please note:

Shipping times and costs vary based on your location and selected shipping method, and will be displayed at checkout
Estimated delivery dates are not guaranteed and are provided for informational purposes only
Risk of loss and title for Products pass to you upon our delivery to the shipping carrier
We are not responsible for delays caused by shipping carriers, customs, weather, or other circumstances beyond our control
You are responsible for providing an accurate shipping address; we are not liable for orders shipped to an incorrect address you provided
International orders may be subject to customs fees, duties, or taxes, which are the responsibility of the customer

6. Returns and Exchanges

We want you to love your Punctum gear. If you’re not satisfied with your purchase:

Products may be returned within 30 days of delivery for a refund or exchange, provided they are unused, in original condition, and in original packaging
Certain items, including final sale items and gift cards, are not eligible for return
Return shipping costs are the responsibility of the customer unless the return is due to our error or a defective product
Refunds will be issued to the original payment method within a reasonable time after we receive and inspect the returned item
We reserve the right to refuse returns that do not meet these conditions

7. Product Warranty

We stand behind the quality of our camera straps and accessories. Specific warranty terms, if any, will be provided with your Product or on our Site.

Except as expressly stated, Products are provided “as is” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by applicable law.

All content on our Site, including text, graphics, logos, images, product designs, and software, is the property of Punctum or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on our Site without our prior written consent. The Punctum name, logo, and related marks are trademarks of our company, and you may not use them without our express permission.

9. User Accounts

If you create an account on our Site, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we believe, in our sole discretion, pose a risk to our business or other users.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Punctum and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use, the Site or Products.

Our total liability for any claim arising from these Terms or your use of the Site or Products shall not exceed the amount you paid for the Product(s) giving rise to the claim.

From time to time, we may offer promotions, discount codes, or special offers. These are subject to specific terms communicated at the time of the offer and may be modified, suspended, or terminated at our discretion.

Promotional offers cannot typically be combined unless explicitly stated and may have restrictions on eligible products, minimum purchase amounts, or expiration dates.
